📄 TERMS OF SERVICE – The Yachts Place Company LLC

Welcome to The Yachts Place Company LLC. By booking, renting, or using any of our vessels or services, you agree to the following Terms of Service, Privacy Policy, and Cancellation Policy.
Please read these terms carefully before making a reservation.

1. DEFINITIONS

  • “Company” refers to The Yachts Place Company LLC.
  • “Client” / “Renter” refers to the individual or group renting the vessel.
  • “Vessel” / “Yacht” refers to any boat, yacht, or watercraft owned or operated by the Company.
  • “Captain” means the operator provided by the Company or chosen by the Client (if allowed).

2. BOOKING REQUIREMENTS

  • Renter must be 18+ to book.
  • A valid government-issued ID is required at check-in.
  • Full payment or deposit must be received to confirm the reservation.

3. CHARTER DURATION & USE

  • Charter time begins at the scheduled start time, not the arrival time of the Client.
  • The Vessel may only be used for lawful purposes.
  • Maximum passenger capacity must be respected at all times in compliance with U.S. Coast Guard regulations.
  • No illegal substances or firearms are allowed on board.
  • The Captain has full authority over navigation and safety decisions.

4. WEATHER POLICY

  • Charters operate rain or shine unless conditions are deemed unsafe by the Captain or the Company.
  • Unsafe weather includes: lightning, strong winds, named storms, or small craft advisories.
  • If the Company cancels due to weather, the Client will receive:
    • Free rescheduling, or
    • A full credit.

5. SAFETY REQUIREMENTS

Clients agree to:

  • Follow all Captain’s instructions.
  • Wear life jackets when instructed.
  • Not jump off the vessel while in motion.
  • Not swim in restricted zones.
  • Avoid excessive alcohol use leading to unsafe behavior.

The Company reserves the right to end the charter early, without refund, if safety rules are violated.

6. DAMAGES & LIABILITY

  • The Client is responsible for any damage caused by negligent or reckless behavior.
  • The Company is not responsible for:
    • Loss of personal items,
    • Injuries caused by misuse or refusal to follow instructions,
    • Third-party actions, including other boaters.

Assumption of Risk:
Boating involves inherent risks. By boarding the Vessel, the Client acknowledges and accepts these risks.

7. ALCOHOL & PROHIBITED ITEMS

  • Alcohol is allowed aboard in moderation.
  • Illegal drugs, fireworks, and weapons are strictly prohibited.
  • Excessive intoxication may result in early termination of the trip without refund.

8. MEDIA & PHOTOGRAPHY

Unless opted out in writing, the Client grants permission for non-identifiable photos or videos taken during the charter to be used for marketing purposes.

9. PAYMENT TERMS

  • Accepted payments: Zelle, Venmo, bank transfer, cash (if allowed).
  • All prices are listed in USD and subject to tax and fuel surcharges where applicable.

10. CANCELLATION POLICY

Client Cancellations

  • Clients never lose the money in any case scenario.
  • Bad Weather – Full Refund.

Company Cancellations

If the Company cancels due to mechanical issues, unsafe weather, or operational concerns, the Client may choose between:

  • Full refund, or
  • Reschedule at no extra cost.

11. PRIVACY POLICY

11.1 Information We Collect

We may collect:

  • Full name
  • Email address
  • Phone number
  • Payment information
  • ID for verification
  • Any information submitted through booking forms

11.2 How We Use Your Information

  • To process bookings
  • To communicate about your reservation
  • For customer support
  • For legal and safety compliance
  • For internal analytics (non-identifiable data only)

11.3 Data Protection

We implement security measures to protect your data.
We do not sell or share personal information with third parties, except:

  • Payment processors
  • Legal authorities (if required)
  • Captains or crew members (only necessary trip info)

11.5 Your Rights

You may request:
